As a small business owner, I was the victim of what's known as "friendly fraud." This crime is where a person receives goods or services, then challenges the charges.
When this crime takes place, traditionally, you have a few choices:
- Write-off the expense
- Go through the costly process of a civil court.
- Press criminal charges (for example, in North Carolina, it is a felony to challenge legitimate credit card charges) - see below:
"The law states that if you knowingly, by means of any kind of false pretense whatsoever, obtain or attempt to obtain money, goods, property, services, or something else of value from anyone else, with the intent to cheat or defraud that person, then you are guilty of a felony."
Motivating the local authorities to take action presents challenges, and the court system can be a wildcard.
But Doesn't Your Payment Processor Defend You?
No. We had a long-standing relationship with one of the largest payment processors in the world, and they couldn't (or wouldn't) stop this person's fraudulent chargeback challenges. When this happens, the small business is left feeling powerless against the bad guys.
Keep in mind; we had multiple sign-offs, plus a sign-off for delivery of goods & services, yet this criminal was still given a refund by his credit card company in excess of thousands of dollars.

This former client also held up our cashflow of additional money, and prevented us from operating optimally for over 3 MONTHS! Not to mention legal fees, time, energy, and much more. The damage credit card fraud causes is significant.
